GM Can be Sued Because of Unsolved Transmission Issues
Recently, it has transpired that a lot of GM car owners are determined to take legal action against the American Auto Giant. The complainant party claims that car owners of several RWD Chevrolet, Cadillac and GMC models (2015 and 2019 model years) experienced shakes, jolts, and hard shifting when engaging a gear during speeding up or slowing down.
It is said that the issue is caused by the malfunction of the 8-speed automatic transmission installed on the abovementioned models. The court challenge was published on ClassAction.org. It is also pointed out that numerous maintenance protocols have been filed about 8-speed automatic transmission issues, but none of them have solved the issue completely.
Alleged cause of the lawsuit
According to the manufacturer’s classification, problems occur in the 8L90 or 8L45 automatic transmission, installed on numerous GM models. It should be noted that the NHTSA has also received many reports about transmission issues detected in GM cars. The issue manifests itself when a driver speeds up or slows down and it’s time to put into a gear. However, some drivers also say problems occur not only during gear shifting, but also within a single gear. Some car owners claim that sometimes jolts were so hard that it felt like another vehicle crashed into them.
It is assumed that the source of the issue lies
in the torque converter. According to the complaint, the defect entails
excessive friction, leading to incorrect operation of hydraulic units and gears
and contributes to the emergence of metal chips inside the transmission. As a
result, the transmission gets out of order and car owners have to pay for
expensive repair services and replacement of worn elements or of the whole
transmission unit.
It is also emphasized that the carmaker has been aware of the issues, since just after the date of the transmission release numerous maintenance protocols related to transmission malfunctions have been issued, but none of them have solved the issue completely. GM representatives refused to comment on the current situation.
The complainant party claims that the automaker
should have informed consumers about the problem and provided repairs services
under the warranty.
